Hello everyone,
I would like some advice from those who have had experience with DWIs. I received my first one this morning. This is my first and only offense that I have had. I was wanting to know what my chances are that I might not have to go serve jail time. I am a full-time student and currently do not work. I am 22 years old. I blew a .20 and I reside in North Carolina. I was appointed an attorney. Anything that would help me?Thank You,

First time stopped for anything? I got a speeding ticket same state first offence and there is a prayer of judgement where the charge is dropped for a first offense don't know if it applies to DWI's though. Good luck . I think the part of the state also matters. Small towns seem to be more lenient. Phillipa

It's different, not just state to state, but county to county. I think it's quite unlikely that you'll have to do jail time. A likely outcome is: fine, probation, attendance of AA meetings. After probation, you may have the DWI expunged from your record. It's a hassle, but one that's quite common.

I know this is WAY late, and your case has probably been handled long ago, buyt I had one DWI while I was living in NYC. I was beyond intoxicated, I was destroyed. I'm not proud of it, believe me. Anyhow, the judge in the preliminary hearing decided that I was honestly remorseful, which I was, and I got time served ( I spent a day in jail while I waited to see the judge), some community service, a license suspension and a fine. I got lucky, in that in NYC, a DUI is a more severe crime than a DWI (strange, I know), but essentially a DWI means that you could have been under the influence of anything, not just alcohol. I slipped into the psychiatric drug category (ativan, at the time). Hope this post finds you well.
